Because the citizens of the state have in fact already
created various agencies to monitor and remedy child
abuse, then the argument that the Court should defer to
the democratic process for recognizing a right of protection
seems to ignore the reality of the circumstances in this
case. One could reasonably conclude that the democratic
process has already spoken and has recognized the right
that Joshua asserted.
