Brennan argues that the state was obligated to protect Joshua from his father's abuse because the state had foreclosed "self-help" remedies and had instituted a governmental system for reporting, investigating, and monitoring abuse situations and for protecting children from such situations. According to Justice Brennan, once this governmental system was triggered in this case, the state had a duty to provide adequate protection for the child and not abdicate its role without compelling justification.
