This argument assumes that individuals in a special
relationship with the state have an "unfair advantage" over
other individuals. The Court, however, never advanced such
an argument. Instead, the Court rejected Joshua's special
relationship argument because it concluded that a key
component of such a relationship was missing from the
facts of this case.
