Correct. Joshua argued that a "special relationship" existed because the state knew he was in danger of abuse from his father and that the state had become involved, by words and action, in protecting him from such abuse. Joshua argued that the state, through its extensive, voluntary actions, acquired an affirmative constitutional duty to protect him from abuse in a reasonably competent manner.
