Professor's Reply: 
 
The Court has construed the constitution as providing a "shield" against governmental power in certain circumstances, particularly in situations that deprive persons of the enjoyment of life, liberty, and property. The Court, however, has consistently held that the constitution generally does not obligate governments to provide affirmative protection of those rights.
