Q3.B.But how does the Court actually describe how this "grave discrimination" manifested itself in particular situations?
 

Well, the Court says that rights enjoyed under the unwritten "general law" vary according to whether enforcement was sought in federal or state court and, if the case involves citizens of different states, some litigants will pick federal courts to take advantage of the more favorable forum's view of the law
